An Order of Protection can be issued in the state of California if there are allegations of domestic violence or abuse that exist. Even when the victim refuses to press charges against the alleged abuser, the district attorney can step in and press charges and ask that an Order of Protection or restraining order be put in place to protect the victim from any further violence. There are different types of Orders of Protection that may be obtained, and they include the following:
- Emergency Protective Order (EPO): an order that is legally valid for up to 5 days. It is typically ordered by law enforcement.
- Domestic Violence Restraining Order (DVRO or TRO): a temporary (or non temporary) restraining order that protects victims of domestic violence. It can be issued for a minimum of 3 weeks up to a maximum of 3 years.
- Criminal Protective Order ("No Contact" Order): an order that is issued for active domestic violence cases only by a California District Attorney.
- Civil Harassment Restraining Order (CHO): this is a civil order that prevents harassment between people who are neighbors, co-workers and/or acquaintances.
